Section 20-13, adopted by Ordinance 3649 in 2011, covers any public street, sidewalk, alley or park, plus any other place open to public view, so the prohibition is not limited to a fixed list of locations; the operative test is whether the act would be visible from a public vantage point. The only carve-out is for someone using a toilet, urinal or commode inside a restroom, bathroom, or other temporary or permanent enclosed structure built for that use, which covers portable toilets at events as well as fixed restrooms.

The section sits in Chapter 20, Article I 'In General,' alongside other public-order offenses like unlawful assembly and disturbing the peace, and like most of that article it carries no fine of its own. That means a violation falls back on § 1-11's general penalty: a fine of up to $500.00, imprisonment for up to six months, or both, at the discretion of the court, and the violator can be held in the city or county jail until the fine and prosecution costs are paid.

Because Article I does not label the offense a continuing one, each act is charged individually rather than accruing a per-day penalty the way an uncorrected nuisance would.
