Concord, NC Public Conduct: Public Urination (2026)

City Code Sec. 30-1(b) declares that the erection, maintenance, or use of any building or place for social gatherings or business in Concord becomes a public nuisance when attendee conduct results in any of a listed set of conditions, and public urination or defecation is named first among them, alongside public drunkenness, unlawful drug or alcohol use, and unlawful litter dumping. The ordinance does not stop at the property owner: Sec. 30-1(c) makes any person who is the owner, occupant, tenant, or otherwise in possessory control of the premises liable if they sponsor, conduct, host, invite, permit, or continue to allow the gathering once it becomes a nuisance.

The same subsection goes further and states that any person attending a nuisance gathering is also in violation of the section, so an individual who urinates in public at a Concord gathering, and anyone who lets the gathering continue afterward, can each be cited. The rule exempts gatherings and businesses held at locations with a valid entertainment center permit, or any other gathering authorized elsewhere in the Code, per Sec. 30-1(d). S. 160A-193, which lets Concord use civil or criminal remedies interchangeably rather than being locked into one enforcement track.
