Summary
It is unlawful in Gainesville to urinate or defecate in, or in view of, a public place other than one designated for that purpose. Code § 17-8 lets police issue a civil citation for urinating in public, and officers do not have to give a warning before writing a citation because the city commission found the conduct irreparable once it occurs.

Full Breakdown
" The ordinance defines a public place broadly as "any place where the conduct may reasonably be expected to be viewed or could be viewed by others," reaching outdoor spaces, sidewalks, parking lots, and any other area where passersby might see the act, not just areas technically open to the public. Urinating in public can be enforced either through a civil citation under Chapter 2, Division 6 of the code, or through the standard penalty in § 1-9 or § 2-339; defecating in public is enforced only under § 1-9.
Each violation is treated as a separate offense that can be separately prosecuted. Unlike most code violations, § 17-8(d)(3) tells code enforcement officers they are not required to give the violator a grace period to correct the conduct before writing the citation, because the city commission found the act to be "irreparable or irreversible" once committed. The commission's stated findings in § 17-8(d) cite vandalism, disease transmission, litter, trespassing and property destruction as the harms the ban is meant to prevent. The section was created by Ordinance No. 020480 in 2002, replacing an earlier version of § 17-8 that had covered public drunkenness before that offense was repealed in 1995.
Violations & Fines
Urinating in public can draw a civil citation under Chapter 2, Division 6, or prosecution under the general penalty in § 1-9 or § 2-339, with each incident charged as a separate offense. Defecating in public is enforced only under § 1-9. Officers can issue a citation immediately, without first giving the person a chance to stop or correct the conduct.
