Linden, NJ Public Conduct: Public Urination (2026)

1 flatly prohibits urinating or defecating on any public street, public sidewalk, any other public place, any other place open to and used by the public, or outdoors on any private property, without carving out any exception for circumstance or location beyond that plain text. 1 and Ord. No. 25-13, so it predates the more recently rewritten noise chapter but has been carried forward unchanged in the current code. 2 sets the penalty by cross-reference to Chapter 1, § 1-5, the City's general penalty section, rather than fixing a unique fine for this offense.

A. 40:49-5, runs from a minimum fine of $100 up to a maximum of $2,000, or imprisonment in the county jail or another place the City designates for detention of up to 90 days, or up to 90 days of community service, at the Municipal Court's discretion. Because the ordinance text sweeps in outdoor conduct on private property as well as public streets and sidewalks, it reaches conduct in a yard or lot visible from the street as well as conduct in a park or on a sidewalk.
