1 makes it unlawful to possess an open container of alcohol or to drink, imbibe or consume any alcoholic beverage on a public street, sidewalk, public parking place, park, playground or recreational area or any other public place; on a public conveyance; in a private motor vehicle whether moving or parked on any public street, lane, parking lot or public place; or on any private property that isn't the person's own without the express permission of whoever controls it. 2 separately bans discarding alcoholic beverage containers, cans or bottles on any of those same public locations or on someone else's private property without permission, so littering the empty can is its own violation even where drinking itself was lawful.

4 routes the permit application for that public consumption through the Recreation Department. Absent that permit, the general ban controls. Violation carries the penalty fixed in Chapter 1, § 1-5, which sets a fine between $100 and $2,000, up to 90 days in the county jail, or up to 90 days of community service for ordinance violations generally.
