Hempstead, NY Public Conduct: Skateboarding Rules (2026)

Section 78-12, titled simply 'Games,' is a single catch-all list of recreational activities the Town restricts to specific park zones rather than allowing throughout park grounds. Roller skating and skate-boarding sit in the same sentence as throwing balls, bean bags, frisbees, knives or missiles; playing organized ball games; flying model aircraft of any size; kite flying and model boating; riding bicycles, scooters, go-carts, motor bikes, motorcycles or beach buggies anywhere other than on roads; archery; and using air rifles, pistols, BB guns or any device that could create a hazard or a nuisance to others.

All of these activities share the same exception: they are permitted only in areas the Director has designated and posted for that specific use. The rule therefore does not ban skateboarding from the Town outright, only from Town park grounds outside a marked skate or wheeled-activity zone; skateboarding on Town sidewalks, streets or in business districts falls outside § 78-12 and is governed, if at all, by separate traffic or public-ways provisions rather than this parks chapter. Because the section groups skateboarding with hazard-oriented items like BB guns and archery, enforcement officers can treat unposted skateboarding the same as any other listed park activity violation, without needing to show actual injury or property damage resulted.
