Full Breakdown
Chapter 13.78 of the Placentia Municipal Code, "Skateboards, Rollerskates and Similar Wheeled Devices," works through posted signs rather than a blanket ban. Section 13.78.020(a) makes it unlawful for anyone using or riding a skateboard, rollerskates or similar wheeled devices to ride or move about on any public or private property when that property has been posted as a no skateboard and/or rollerskate area. A street, plaza or lot with no sign is not covered by this section.
The property owner carries the signage duty. Under § 13.78.020(b), before the prohibition can be enforced, the owner of the designated area must post a sign stating: "Skateboarding and rollerskating is prohibited by PMC 13.78.020. Fines up to $150." The sign must be posted in plain view, be not less than 12 inches by 18 inches, and carry lettering not less than one inch in height. Section 13.78.020(c) adds that the section does not stop a property owner from conducting scheduled special events or stop people from taking part in them.
The definitions in § 13.78.010 set the scope. A "skateboard" is a board of any material with wheels attached, propelled or moved by human, gravitational or mechanical power, with no device or mechanism fixed to turn or control the wheels. A "rollerskate" is any footwear, or device attached to footwear, with wheels on the bottom. "Private property" means property held by private interests and used primarily for business, commercial or recreational purposes, and "public property" means property owned or maintained by the city or by another public entity.
A separate rule in § 13.20.040 bars anyone riding a bicycle, motorcycle, coaster, roller skates or any toy vehicle from attaching the vehicle or themselves to any moving vehicle on a roadway.
Violations & Fines
Under § 13.78.020(d), any violation is an infraction punishable by a fine of $75 for the first offense, $100 for the second offense and $150 for the third offense. No fine can be enforced at a location until the owner has posted the required sign of at least 12 inches by 18 inches with lettering not less than one inch high.
