Penalties. Any person violating any provision of this section or any rule, order or regulation made pursuant to this section shall be prosecuted in the same manner as misdemeanors are prosecuted and upon conviction, shall be punished by a fine not to exceed $500.00, or by imprisonment in the county jail not to exceed 60 days, or by both such fine and imprisonment.

Both boardwalks sit on Santa Rosa Island, the leasehold barrier island administered through the Santa Rosa Island Authority. Subsection (b) lets the board of county commissioners designate additional public areas where wheeled vehicles are off-limits, but any such prohibition, whether from this section or a future resolution, only takes effect once signs are posted; the board or the SRIA can put the signs up.
Subsection (c) extends the same rule to private property, so long as the owner, lessee or person in charge has posted no-wheeled-vehicle signage. Where wheeled vehicles are allowed, subsection (d) still requires riders to yield to pedestrians and not endanger or interfere with foot traffic. The rule applies only to areas actually posted, so a skateboarder is legal on unposted Pensacola Beach streets and sidewalks; it is the two named boardwalks, not the beach generally, that are off-limits.
Violations & Fines
Violating § 94-5, including riding a skateboard on either posted boardwalk, is prosecuted the same way a misdemeanor is prosecuted. Conviction carries a fine of up to $500.00, up to 60 days in the county jail, or both, per § 94-5(e).
