Cheektowaga, NY Public Health Rules: Rodent Control (2026)

Article IV of the Building Construction Codes Administration chapter (Ch. ' The operative rule, § 70-31F, requires that 'adequate sanitary facilities and methods shall be used for the collection, storage, handling and disposal of garbage and refuse' and that storage containers be 'of an approved waterproof and rodent-resistant type,' shielded from the street by landscaping or architectural screening wherever practical. Dumpsters and other large receptacles get the same treatment plus solid fencing or walls. Separately, § 70-11C(6) requires that three weeks before any demolition permit work begins, the premises be baited for rodent control by a licensed exterminator, closing off the classic rodent-flight problem when a building comes down.

The Supervising Code Enforcement Officer and Building Inspection Department administer and enforce Chapter 70 under §§ 70-3 and 70-5, and can issue a written violation order under § 70-7 identifying the premises, the defect, and the remedial action required, served personally, by posting, or by certified mail. If an owner ignores the order, § 70-8 lets the Town abate the nuisance itself and place the cost as a lien on the property's tax bill, while § 70-9 makes noncompliance punishable in court by up to a $250 fine or 15 days in jail, each day of continued violation counted as a separate offense. The chapter binds the Town of Cheektowaga outside the Villages of Depew and Sloan, which run their own codes.
