Under Lincoln Municipal Code Chapter 5.38, operating a rental dwelling with three or more units or a transitional living facility requires a permit, and the Building Official must inspect the exterior and common areas before that permit issues or renews (§ 5.38.040). The default cycle is every 12 months. A property moves to a 24-month cycle after passing an inspection with no violations and none in the prior 12 months, with fees current. It drops to a 6-month cycle after repeated complaint-based violations within a year, the number of complaints needed to trigger this scales with building size, from two complaints for a 3-to-12-unit building up to five for buildings over 36 units, and it stays there until two consecutive clean six-month inspections. Separate provisions (§ 5.38.045) require full interior inspections once specific complaint thresholds are met.
