Whenever a petition is filed with the code enforcement officer by a public authority or by at least five residents of the town charging that any dwelling unit is unfit for human habitation or whatever it appears to the code enforcement officer, on inspection, that any dwelling or dwelling unit is unfit for human habitation, such officer shall, if the preliminary investigation discloses a basis for such charges, issue and cause to be served on the owner or any parties in interest in such dwelling or dwelling unit a complaint stating the charges and containing a notice that a hearing will be held before the code enforcement officer at a place therein fixed, not less than ten nor more than 30 days after the serving of the complaint.

Full Breakdown
Under Apex Town Code § 5-100, the code enforcement officer opens a formal case against a rental dwelling one of two ways: a written petition from a public authority or from at least five town residents alleging the unit is unfit for human habitation, or the officer's own on-site inspection reaching that conclusion. A single tenant complaint alone does not trigger the petition route, it takes five residents or a public authority, though nothing stops the officer from inspecting after one complaint. Once triggered, the officer serves the owner a written complaint and schedules a hearing 10 to 30 days out, implementing the state's minimum housing code authority under G.S. 160D-1201.
Violations & Fines
Owners who ignore a repair, vacate, or demolition order after the hearing face a town resolution seeking a court order to compel compliance; the officer may then placard the dwelling as unfit and record a lien for the costs.
