Full Breakdown
Chapter 63 of the Bethel Code spells out what a landlord must provide before renting a dwelling unit. Section 63-4 requires a working kitchen sink connected to an approved water supply and sewer or septic system, cabinets or shelves for food storage, a stove and a refrigerator holding food below 45 degrees Fahrenheit, a private nonhabitable room with a flush water closet, a room with a lavatory sink, a bathtub or shower, an approved means of egress, and locking devices on every exterior door. Section 63-5 sets minimum window area at 10% of a habitable room's floor area and requires ventilation equal to 45% of that window area if a room cannot be opened directly.
Section 63-6 requires heating facilities able to hold 68 degrees Fahrenheit when it is 0 degrees outside, measured 60 inches above the floor, and bans unvented flame space heaters. Section 63-3 makes owners responsible for shared and public areas of multi-unit buildings and requires occupants to keep their own space clean and store rubbish safely. Section 63-7 requires foundations, roofs and walls to stay weathertight and rodentproof, bans lead paint on interior surfaces accessible to children, and requires door and window screens with at least 16 mesh during insect season.
The Basic Building Code Board of Appeals hears disputes, and under § 63-16 the enforcing officer can condemn and placard a unit found unfit for human habitation, forcing immediate vacancy until the defect is fixed and the placard is removed with written approval.
Violations & Fines
Section 63-15 sets the penalty for violating any provision of Chapter 63 at not less than $50 nor more than $100 per conviction. Removing a condemnation placard without authorization under § 63-16 carries a separate fine of $25 to $50. If an owner takes no corrective action within six months of a condemnation and no appeal is pending, the enforcing officer may order the structure demolished. A tenant or owner aggrieved by an enforcement order can request a hearing before the Basic Building Code Board of Appeals.
