Summary

In the City of Charlottesville, Virginia, a landlord renting five or more dwelling units in one building must install a peephole and dead-bolt lock, sliding-door locks and window locking devices meeting Uniform Statewide Building Code standards, but only when a tenant asks in writing. City Code § 5-3 gives the landlord ten days after that written request to comply.

(a)Any landlord who rents five (5) or more dwelling units, as defined in the Virginia Residential Landlord and Tenant Act, section 55-248.4 ), in any one (1) building shall install the following devices upon the written request of the tenant:(1)Peepholes, and dead-bolt locks which meet the requirements of the USBC for new multi-family construction, within any exterior swinging entrance door to such tenant's unit; however, the landlord shall not be required to install a peephole in any door having a glass panel;(2)Manufacturer's locks which meet the requirements of the USBC, and removable metal pins or Charlie bars which meet requirements of the USBC, on exterior sliding glass doors located on the first two (2) levels of a building; and(3)Locking devices which meet the requirements of the USBC, on all exterior windows.(b)Any landlord subject to this section shall have a reasonable time in which to comply with its requirements. For the purposes of this section, ten (10) days following receipt of written notice of a tenant or the city's building maintenance official shall be deemed a reasonable time.

Full Breakdown

" On a tenant's written request, that landlord must install, at the tenant's unit, a peephole and a dead-bolt lock meeting the USBC's new multi-family construction requirements on any exterior swinging entrance door, though a peephole is not required in a door that already has a glass panel. The same request also obligates the landlord to add manufacturer's locks plus removable metal pins or Charlie bars meeting USBC requirements on exterior sliding glass doors on the building's first two levels, and USBC-compliant locking devices on all exterior windows.

The ordinance does not make the landlord install these devices proactively in every unit; the duty is triggered only when a tenant asks in writing. Once triggered, § 5-3(b) gives the landlord a defined compliance window: ten days after receiving the tenant's written notice, or after written notice from the city's building maintenance official, counts as a "reasonable time" to finish the installation. 13:1, part of the state landlord-tenant act, which lets a locality require these security devices in multi-unit buildings; Charlottesville adopted that local option here rather than leaving it to lease negotiation.

Because § 5-3 sits in Chapter 5's general provisions rather than the unsafe-structures division, a landlord's failure to comply after the ten-day window is treated as a Chapter 5 violation rather than a separate housing-code offense.

Violations & Fines

A landlord who does not install the requested peephole, dead-bolt, sliding-door or window locks within the ten-day reasonable-time window in § 5-3(b) is in violation of Chapter 5, punishable under § 5-1 as a Class 1 misdemeanor with a fine up to $2,500, plus liability for any damages the failure causes the tenant.

Frequently Asked Questions

Can I make my Charlottesville landlord install a dead-bolt lock?
Yes, if your building has five or more dwelling units. City Code § 5-3 requires the landlord to install a peephole and USBC-compliant dead-bolt lock on your exterior entrance door once you ask in writing, along with matching locks on sliding glass doors on the first two floors and on exterior windows.
How fast must my landlord install the requested locks?
Section 5-3(b) treats ten days after your written request, or after written notice from the city's building maintenance official, as a reasonable time to comply. The ordinance does not set a firm statutory deadline beyond that reasonable-time standard.
Does this apply to a single-family rental house?
No. Section 5-3 only reaches a landlord who rents five or more dwelling units in one building, as defined by the Virginia Residential Landlord and Tenant Act. A single-family or duplex rental falls outside this specific security-device requirement.
