Coconut Creek, FL Rental Property Rules: Repairs & Habitability (2026)

Section 6-16 of the Coconut Creek Code adopts the Minimum Housing Code for Broward County, Florida, codified as Sections 5-52 through 5-73 of the Broward County Code of Ordinances, into city law as amended from time to time. The habitability standards themselves therefore sit in the Broward County Code, and the city text supplies the enforcement machinery around them.

Section 6-17 gives the city's code enforcement inspectors concurrent jurisdiction with the county to enforce the housing code. They are charged with inspecting buildings and premises and issuing violation notices, and they consult the enforcing officers of the county division of building and zoning when needed. Section 6-18 requires the city clerk to keep two certified copies of the county code on file, open for public inspection and copying during reasonable business hours. Section 6-38 settles conflicts: where the City Code and the Broward County Minimum Housing Code disagree, the City Code takes precedence.

Layered on top are the city's own minimum building premises standards in Article III. Section 6-33 defines a dwelling as any building wholly or partly used for living, sanitation, sleeping, cooking and eating, including group homes and community residential homes. Section 6-36 requires the owner, operator or occupant to keep exterior doors, garage doors and windows in a state of good repair and substantially weathertight and infestation proof, and to keep roofs and gutters maintained so water does not leak into the building. Section 6-35 authorizes the community improvement officer to inspect with the consent of the owner, operator or occupant and to pursue legal means to secure inspection when consent is refused. The abatement steps in Section 6-37 give a property owner ten days to abate a public nuisance after notice.
