Summary

The City of Greenwood's Property Maintenance Code, City Code § 6-287, requires every owner to keep a rental structure and its exterior premises in a sanitary and safe condition before renting it out. Occupants must keep the portion of the unit they control clean as well. Community Development Services' Code Enforcement Officials enforce the standard citywide under the Common Council's ordinance.

(a) Scope. The provisions of this chapter shall govern the minimum conditions and the responsibilities of Persons for maintenance of Structures, equipment and Exterior Property and the installation of Improvements on the Premises. (b) Responsibility. The Owner of the Premises shall maintain the Structures and exterior Premises in compliance with these requirements, except as otherwise provided for in this Code. A Person shall not occupy as Owner/Occupant or permit another Person to occupy Premises which are not in a sanitary and safe condition and which do not comply with the requirements of this Code. Occupants of a Dwelling Unit are responsible for keeping in a clean, sanitary and safe condition that part of the Dwelling Unit or Premises, which they occupy and control.

Full Breakdown

Greenwood's Property Maintenance Code (Sec. 6-285 et seq. of the General Ordinances) applies uniformly to all existing residential and nonresidential structures in the city, including rental housing, and sets minimum standards for sanitation, structural soundness and safety regardless of when the building was built. Under § 6-287(b), the property owner must maintain the structure and exterior premises in compliance with the code, and no owner or occupant may occupy, or allow another person to occupy, premises that are not sanitary and safe; occupants remain responsible for the portion of the dwelling unit they control.

Companion sections fill out what 'habitable' means: § 6-289 requires exterior walls, roofs, foundations, windows, doors, stairways and handrails to be structurally sound, weather-tight and free of holes or rot, with boarded windows limited to ten consecutive days, and § 6-290 makes the owner of a multi-unit structure responsible for extermination of insects, pests and rodents throughout the building and its exterior property. Community Development Services' Code Enforcement Officials administer the code and, under § 6-285(d)(3), may inspect a rental's interior only on a complaint giving reasonable grounds for a violation, or as part of a scheduled inspection program, between 8:00 a.m. and 8:00 p.m. on any day but Sunday; if the owner or tenant refuses entry, the official can seek a search warrant with police assistance. Enforcement starts with a Notice of Violation and, at the City's discretion, a warning citation before a formal charge is filed.

Violations & Fines

A first Property Maintenance Code violation carries a $50 fine under § 6-285(f)(4); every day the violation continues after notice is a separate $50 offense. A repeat violation committed 30 days to two years after an earlier one doubles to $100 per day under § 6-285(f)(5). Daily fines keep accumulating until they reach the small-claims jurisdictional limit of the Johnson Circuit and Superior Courts or compliance is achieved, and the City may also sue to restrain, correct or abate the violation.

Frequently Asked Questions

Who has to keep a Greenwood rental habitable?
Under City Code § 6-287(b), the property owner must maintain the rental structure and its exterior premises in a sanitary, safe condition that complies with the Property Maintenance Code. Tenants are separately responsible for keeping clean whatever part of the dwelling unit or premises they personally occupy and control, but the owner cannot let the unit fall out of compliance.
Can Greenwood inspect the inside of my rental unit?
Only under limited conditions. Section 6-285(d)(3) lets the Code Enforcement Official inspect a structure's interior when a complaint gives reasonable grounds to believe a violation exists, or as part of a scheduled citywide inspection program approved by the Board of Public Works and Safety. Inspections run between 8:00 a.m. and 8:00 p.m., never on Sunday, and a refusal can lead the City to seek a search warrant.
What happens if a landlord ignores a habitability violation notice?
The Code Enforcement Official issues a Notice of Violation, and under § 6-285(f) the owner is fined $50 for the first offense, with each additional day after notice a separate $50 offense. A second violation within a two-year window doubles the daily fine to $100 until the property is brought back into compliance or the fines reach the local small-claims court's jurisdictional cap.
