Oakley does not currently operate a rental registration program, but landlords must comply with the statewide Tenant Protection Act (AB 1482), California Civil Code habitability requirements, and local business licensing for rental activity. Properties must meet building, housing, and safety codes, and landlords must disclose state-mandated information to tenants.
Unlike some Bay Area cities (Berkeley, Oakland, San Francisco) that operate rental registration and rent board programs, Oakley does not administer a mandatory rental registration or rent control ordinance. However, rental property operators in Oakley must: (1) obtain a Oakley business license under Municipal Code Title 3 for rental activity conducted as a business; (2) comply with California's statewide Tenant Protection Act of 2019 (AB 1482, Civil Code sections 1946.2 and 1947.12), which imposes just-cause eviction requirements and annual rent caps (5% plus CPI, max 10%) on most residential properties older than 15 years, with exemptions for single-family homes owned by individuals (not corporations/REITs) who provide statutory notice, duplexes where the owner occupies one unit, and properties subject to other rent control; (3) maintain habitability under Civil Code section 1941.1 and Health and Safety Code sections 17920.3 and 17920.10, including weatherproofing, plumbing, heating, electrical, sanitation, and pest-free conditions; (4) deliver state-mandated disclosures including the AB 1482 addendum, lead-based paint disclosure for pre-1978 housing, Megan's Law notice, mold disclosure, flood hazard disclosure (AB 1394 β required for units in FEMA SFHA as of July 2025), bed bug disclosure, and smoke/CO detector confirmation; (5) provide 24-hour notice before entering the unit except in emergencies. Security deposits are capped at two months' rent for unfurnished and three months for furnished (AB 12, effective July 2024, generally caps at one month for most landlords). Short-term rentals (stays under 30 days) are separately regulated and require TOT collection.
