Full Breakdown

Section 136A-3 caps both primary and non-primary residences at 150 rental days per calendar year, and the days need not be consecutive. Operating legally requires a city license from the Accounts Department, a passing Saratoga Springs Fire Department inspection within the prior 12 months, at least $300,000 in liability coverage, and a property contact within 50 miles available 24/7. Code Enforcement Officers enforce the chapter, adopted 12-17-2024 by L.L. No. 5-2024 with a June 1, 2025 licensing deadline. Stays of 30 or more consecutive days fall outside the short-term rental definition and the 150-day cap.

Violations & Fines

Fines run up to $2,500 for a first violation, $5,000 for a second, and $7,500 for a third within five years; each week counts as a separate violation. Three violations in two years can revoke the license.
