Baytown does not impose a dedicated short-term rental occupancy cap. STR guests are governed by general Property Maintenance Code overcrowding rules and the Unified Land Development Code dwelling-unit definition rather than an STR-specific per-bedroom formula.
Baytown has not adopted a stand-alone short-term rental ordinance, so no Baytown-specific guests-per-bedroom limit exists in the City Code. Occupancy is regulated indirectly through the International Property Maintenance Code overcrowding provisions adopted under Chapter 18 and through the Unified Land Development Code definition of a dwelling unit, which requires a building used as a single residence with facilities for sleeping, cooking, and sanitation. The IPMC sets minimum room area per occupant. The ULDC also limits residential use of a dwelling to one household, so high-occupancy STR use in a single-family district can trigger zoning enforcement. Texas Local Government Code Chapter 250 sets the framework for STR regulation but does not create a state occupancy formula.
Exceeding IPMC minimum-area-per-occupant standards or using a single-family dwelling for group lodging that violates the ULDC residential use can trigger code enforcement, citations, or zoning violation notices, with municipal court fines up to $500 per offense per day.
