Fayette County, GA Short-Term Rentals: Occupancy Limits (2026)

Section 8-211 sets the operating rules for permitted tourist accommodations in unincorporated Fayette County. Subsection (d) confines guest sleeping space to an actual bedroom, defined in § 8-200 as an attached room of at least 70 square feet with no dimension under seven feet and a closet, so a converted garage, basement nook or outbuilding cannot be marketed as a guestroom. Subsection (e) then caps occupancy at no more than two guests per guestroom, with the only carve-out being an A-R bed and breakfast inn that complies with the county zoning code's bed and breakfast standard at § 110-169.

Subsection (c) reinforces the space limits by barring any detached structure or recreational vehicle from being used as a tourist accommodation at all, meaning a backyard cottage, converted shed or parked camper cannot be rented out even if it otherwise meets the bedroom definition. Operators must also post the maximum overnight occupant count on a notice visible to guests under § 8-206(b)(2), alongside the local contact person's 24-hour phone number and a statement that special events or private functions are not permitted at the property under § 8-212.
