Truckee, CA Short-Term Rentals: Occupancy Limits (2026)

Truckee Municipal Code Section 5.02.030 sets the maximum occupancy an operator must state on a transient occupancy registration certificate application. For a short-term rental, subsection D.5 caps occupancy at two guests per bedroom plus two additional people, excluding children under thirteen, and that ceiling applies specifically between 10:00 p.m. and 7:00 a.m. For a hosted rental, where the homeowner or an eligible tenant occupies the dwelling as a primary residence and rents out a single bedroom, subsection E.6 caps occupancy at two guests, or fewer if the operator chooses, again with the 10 p.m. to 7 a.m. window controlling.

Operational Standards in Section 5.02.040 back the cap with enforcement machinery: subsection A.1 makes the operator responsible for collecting and keeping each guest's name, contact information, and headcount for three years and turning those records over to the Town within five days of a request; subsection A.6 requires the maximum guest count to be posted inside the rental in a visible location; and subsection A.13 requires every advertisement to list the certificate-approved maximum occupancy. A local contact person must be reachable by phone within thirty minutes and physically on-site within sixty minutes to respond to a complaint that guests exceed the posted limit.

Because the town-wide short-term rental certificate cap sits at 1,255 under Section 5.02.030.G.1, an occupancy violation that leads to certificate revocation also forfeits the operator's place in that inventory and any waitlist position for a year.
