Brick Township adopted Ordinance No. 21-20 in November 2020 banning short-term rentals under 30 days, with a barrier island exception allowing minimum 7-day rentals from May 15 through October 15. Registration with the Township Clerk and a $250/year business license are required.
Chapter 239 (Short-Term Rentals) prohibits renting or leasing any dwelling or segment thereof for a term of less than 30 days throughout most of Brick Township. The barrier island (southeast of Mantoloking Bridge, between Barnegat Bay and the Atlantic Ocean) permits minimum 7-day rentals during the seasonal period from May 15 through October 15 only. Operators must register with the Township Clerk's Office and obtain a business license at $250 per year. All rental properties require a Rental Certificate from Code Enforcement with inspection prior to tenant occupancy. Advertising any rental that fails to comply with the ordinance is independently prohibited.
Fines up to $1,000 per day under N.J.S.A. 40:49-5. Each day a violation persists is a separate offense. The Township may revoke the short-term rental license. Enforced by Code Enforcement and Police.
