Eastvale, CA Sidewalk & Pedestrian Rules: Encroachment Permits (2026)

08, retitled 'Excavations in the Public Right-of-Way' by Ord. No. 2013-05 in May 2013, is Eastvale's encroachment-permit ordinance: it governs any private work that disturbs, digs into, or places something on or under a city street, sidewalk or other public right-of-way. Sec. 030 makes it unlawful to excavate, dig, tear up, fill, cover or otherwise disturb any street or public place, or to place any obstruction, impediment or material there, without first getting an excavation permit from the director of public works. Sec. 050 requires a written application identifying the applicant, the exact location and dimensions of the work, its purpose, a start date and completion timeline, proof of current city business registration, insurance, a director-approved traffic control plan, and a nonrefundable application fee set by city council resolution.

Under Sec. 060, an issued permit is not transferable and is automatically cancelled if work does not begin within 30 working days, unless the director grants an extension for good cause; no one with an outstanding chapter violation can obtain a new permit until it is corrected. Sec. 070 requires the permit or a copy to be kept on-site for inspection by police or city staff, and Sec. 100 makes the permittee responsible for restoring pavement, traffic loops and pavement markings, and for keeping the excavation safe until it is repaved.

Work performed outside the permitted location or scope, or without a permit at all, is declared a nuisance under Sec. 030 and can trigger permit revocation under Sec. 090.
