104 of the Hercules Municipal Code makes it unlawful to encroach on, obstruct, alter, or place any structure, pipeline, fixture, or vehicle of prohibited dimension on or under a right-of-way or water course without first obtaining a permit under Chapter 7-1. 203). 105 flatly prohibits certain encroachments outright, including loading docks, sign-support poles, underground tanks or vaults (except for public utilities), and trenching in any street resurfaced within the prior five years absent a Director waiver. 213). 107 by showing substantial damage from refusal, no reasonable alternative, and no detriment to public safety.
Violations & Fines
Encroaching without a permit is not separately penalized within Chapter 7-1, so it falls under the citywide default in Section 1-4.01: a misdemeanor punishable by a fine of not more than $1,000, imprisonment of not more than six months, or both, with each day of continued unpermitted encroachment charged as a separate offense. The Director of Public Works may also cancel a permit and order the right-of-way restored to its former condition at the permittee's expense under Section 7-1.209 if work is not diligently prosecuted.
