Section 28-39 sits in chapter 28's article on unlawful acts affecting streets and sidewalks, and it does two things at once. First, it bans breaking or destroying the curbing of any street, or otherwise defacing it, full stop. Second, it separately requires anyone who wants to construct an entrance into their property from a paved street to get a written permit first from either the town administrator or the public works director; without that permit in hand, cutting a new driveway entrance is treated the same as vandalizing the curb.

The permit requirement sits alongside a cluster of related right-of-way rules in the same article: section 28-41 bars obstructing drains, ditches or watercourses within town limits and requires the property owner to keep the streambed clear of obstructions and free of overgrowth that blocks sunlight; section 28-44 makes owners keep fences adjacent to a street or alley in good repair, on pain of the police chief declaring a dilapidated fence a nuisance and removing it; and section 28-45 lets the administrator remove or trim any shrubbery, tree, fence or other obstruction from a public street or sidewalk that creates a dangerous condition for pedestrians or vehicles.

None of those companion sections carries its own dollar fine, so a permit violation under 28-39 falls back on the town-wide general penalty in section 1-7.
