010(A) bars anyone from placing, constructing, or maintaining an approach road, driveway, pole, pipeline, conduit, sewer, ditch, culvert, billboard, advertising sign, or any other structure or object within a county road right-of-way without first obtaining permission from the County Commission. If an unpermitted encroachment goes in anyway, the Commissioners can remove it directly or serve written notice, by personal service or registered mail plus a posted copy on the installation for ten days, giving the responsible person ten days to remove it. If it is not removed in time, the County may remove it at that person's expense and recover both the removal cost and ten dollars for every day the installation remained in the right-of-way after notice was complete.
If the person disputes the installation or refuses removal, the Commission can sue to abate it as a nuisance and recover the same daily ten-dollar charge plus court costs. 030 requires permission for bridges, ditches, waterways, headgates, and water mains crossing a right-of-way. 06 (Road Access Permits), issued by the County Engineer rather than the Commission, with its own fee, application, and design standards including driveway width and spacing limits.
