Summary

(a)No person shall place any goods, wares, merchandise, foodstuffs or similar items on, or in any way obstruct, any street, sidewalk, walkway of the city or occupy or use any of such sidewalks or walkways or other public right-of-way or use any such public right-of-way for the display or sale of any goods, wares, merchandise, foodstuffs or similar items, except either pursuant to a permit issued in accordance with section 7-2400 of the zoning ordinance and section 5-2-29(g) of this code or when receiving or delivering such items, in which case the items may remain on the public right-of-way only so long as is reasonably necessary for the delivery of same.

The only lawful ways around the ban are a permit issued under Sec. 7-2400 of the zoning ordinance together with Sec. 5-2-29(g) of the city code (the outdoor retail display and dining permit track administered by the directors of transportation and environmental services and of planning and zoning), or a brief window while an item is actually being received or delivered, during which it may sit on the right-of-way only as long as reasonably necessary.
Sec. 5-2-29 sets the mechanics for any permitted encroachment: it must not unduly obstruct the right-of-way or interfere with access and safety, and stationary or non-permanent fixtures such as planters, benches and outdoor dining must leave a minimum five-foot clear path for pedestrians. A related provision, Sec. 5-2-23, allows packing or unpacking oversized shipping crates on a sidewalk only when the box cannot fit through the building's door, and only if ample pedestrian space is preserved and debris is cleared immediately. Sec. 5-2-16 does not state its own penalty class, so the citywide default in Sec.
1-1-7 applies: a fine of up to $2,500 or imprisonment of up to 12 months, or both, with each day of a continuing obstruction treated as a separate violation.
