Escondido, CA Sidewalk & Pedestrian Rules: Obstruction Rules (2026)

Article 1 of Chapter 23 (Streets and Sidewalks) lets the city engineer order removal of any fence, building or other obstruction that encroaches on a street, alley or public ground under Section 23-1. The engineer gives oral or written notice to a city resident responsible for the obstruction, or posts notice in three public places if that person lives outside the city, and the obstruction must come down within 10 days. If it is not removed, or removal is not diligently pursued before the 10 days run out, Section 23-2 lets the engineer remove it directly and recover the cost and expenses from the owner or responsible party through legal action.

Section 23-3 separately bars placing, keeping or exposing any sharp or dangerous tool, implement or machine on a sidewalk for advertising or exhibition, or leaving any tool, implement or machine on a sidewalk for more than six hours where it could endanger the limbs or safety of a passerby; authorized encroachments are exempt. Section 23-4 bars placing or leaving goods, wares, merchandise or other obstructions on a sidewalk beyond the building line, unless the display is permitted under the Chapter 33 outdoor-display-and-sale rules, the Downtown Specific Plan, or the Safe Sidewalk Vending Ordinance in Chapter 16, Article 9.

Section 23-5 adds a parallel ban on placing goods, tools or merchandise on the outer or street side of a sidewalk, again subject to the vending exception. These sections trace to the 1957 Code and were last amended by Ordinance No. 2014-07, with the merchandise sections further amended by Ordinance No. 2026-04R.
