Frederick, MD Sidewalk & Pedestrian Rules: Obstruction Rules (2026)

2(a) sets the general rule: except as otherwise provided in Chapter 22, a person may not obstruct a City sidewalk by placing boxes, barrels, goods, wares, tables, chairs, merchandise, or any other thing on it. Subsection (b) carves out a permit-free exception only for businesses in the downtown commercial/residential (DB) zoning district, letting them display retail goods on the sidewalk directly in front of their storefronts, either against the building or against the curb. That exception comes with six operating conditions: displays must come off the sidewalk during non-business hours; the operator must clean the affected sidewalk area daily; the display cannot block access to hydrants, streetlights, phones, mailboxes, or transit stops; a clear unobstructed sidewalk width of at least 5 feet must remain between the display and any tree, tree well, parking meter, fire hydrant, streetlight, bike rack, trash can or other obstacle; a clear height of 8 feet must be kept beneath any tree branch, sign, awning or overhead obstacle; and the display cannot block building egress or vehicle ingress/egress. 9 and was last amended by Ordinance No. G-16-09 in 2016, the same ordinance that created Frederick's separate Sidewalk Cafe permit article. 1.
