Jacksonville, FL Sidewalk & Pedestrian Rules: Obstruction Rules (2026)

Jacksonville pairs two separate legal tools against sidewalk and street obstructions. 117 makes it a class D offense to willfully obstruct "the free, convenient and normal use of a sidewalk, street, highway, bridge, alley or road, or a public passageway of any public building or structure" with the specific intent to impede, hinder, retard or restrain traffic or passage, and without other lawful purpose; the intent element means accidental or momentary blocking, like a delivery truck pausing or a resident carrying groceries, doesn't by itself violate the Section.

102, in Chapter 746 (Street Use Regulations), gives the Sheriff direct authority to physically remove an unlawful encroachment or obstruction from a street, park or other public place, without waiting on a citation or court order. S. Ch. 162, Pt. I and Ordinance Code Ch. S. Ch. 162, Pt. II and Ordinance Code Ch. 609, or by an action for injunctive relief carrying a civil penalty of $500 for each day the violation continues. 105 caps the civil penalty at $500 per violation and reduces it for anyone who pays rather than contests the citation; the citation is issued by a City Code Enforcement Officer, filed with the County Court, and the recipient has ten calendar days to pay or request a court date. Both provisions date to the mid-1900s Code and remain in force under their current numbering.
