National City, CA Sidewalk & Pedestrian Rules: Obstruction Rules (2026)

Section 7.18.040 of the National City Municipal Code, in the On-Street Activities chapter of Title 7, is the general sidewalk rule. Subsection A requires specific written permission from the city council before anyone places an obstacle, sign, placard, exhibit, display or other item on a public sidewalk or street parkway. The one built-in exception covers garbage and refuse receptacles placed on sidewalks for collection as provided in Chapter 7.10. Subsection B directs the public works director to summarily remove and dispose of obstacles improperly placed on public property, a public sidewalk or a street parkway. Section 7.18.010(B) treats an unimproved sidewalk, meaning the portion of a street parkway between the edge of roadway and the property line used as a walkway, as a public sidewalk.

The neighboring sections close the gaps. Section 7.18.050 makes it unlawful to place trash, building materials or obstacles of any kind on public streets or alleys, except as provided by the California Vehicle Code, and the actual cost of removal and of restoring any damaged roadway is paid by the violator. Section 10.50.010 makes it unlawful to obstruct any public street, alley, bridge, wharf or sidewalk or render it inconvenient or dangerous to pass, and the street superintendent gives the responsible party notice to remove the obstruction before having it removed. Large commercial refuse containers of three cubic yards or larger can sit on the public right-of-way only when placed by the franchised trash disposal agency, no more than six inches from the curb, and for no longer than one week without a time extension from the director of public works.

Vehicles count as obstructions too. Section 7.18.020 bars parking or leaving unattended any vehicle so that any part overhangs a public sidewalk, a street parkway, or the space between the property line and the curb, and § 7.18.030 bars parking within or upon a street parkway. In both cases the police department tows and impounds the vehicle at the owner's expense under California Vehicle Code Section 22654 et seq.

Property owners also carry a duty. Section 13.04.280 charges anyone owning or having charge of property with keeping adjacent sidewalks, curbs and gutters free and clear of dirt, rocks, debris and other obstructing materials, and § 7.14.050 adds containers, waste, trash, weeds and discarded chewing gum.
