Summary

Grand Rapids' Charter makes abutting owners responsible for sidewalk repair, but that duty is expressly switched off while the City's current 1.5%/0.75% income tax rates remain in effect.

It shall be the duty of every owner of land situated in the City of Grand Rapids to build, rebuild, maintain and repair all sidewalks upon that part of the street or streets upon which said land abuts... While both a City Income Tax rate of 1.5% is in effect for corporations and resident individuals and a City Income Tax rate of .75% is in effect for non-resident individuals, the above provision concerning sidewalks shall be of no force or effect.

Full Breakdown

Grand Rapids City Charter, Title X, § 23 makes every landowner responsible for building, rebuilding, maintaining and repairing the sidewalk abutting their property, with the City able to do the work and lien the cost if an owner refuses. But the same section contains a suspension clause: it is 'of no force or effect' while the City's income tax is 1.5% for residents and corporations and 0.75% for non-residents, the rates Grand Rapids has actually levied since 2010. That means the owner-repair duty is not currently operative; the Charter's separate 'Sidewalk Funding' section instead lets the City Commission pay for sidewalk repairs itself using outside grant money.

Violations & Fines

While suspended, failing to repair a sidewalk carries no penalty under this Charter section; if the tax-rate condition ever lapses, the City could again bill or lien an owner's property for repairs it performs after notice.

Frequently Asked Questions

Are Grand Rapids property owners required to fix the sidewalk in front of their house?
Not currently. City Charter Title X § 23 imposes that duty, but the same section suspends it while the city income tax sits at 1.5%/0.75%: its actual current rate.
Who pays for sidewalk repairs in Grand Rapids right now?
The City, using the funding authority in Charter § 26 (Sidewalk Funding), since the owner-repair duty in § 23 is presently switched off by its own tax-rate clause.
