The maintenance of a sidewalk or shared use path constructed on private property shall be the responsibility of the property owner. The maintenance of a sidewalk or shared use path constructed within the public right-of-way or public sidewalk easement may be specified in writing between the city engineer and property owner; and absent any writing specifying responsibility for maintenance, such maintenance shall be the responsibility of the city.(d)Material and dimensions. Sidewalks and shared use paths constructed under this section shall be constructed per the requirements of section 130-2.(e)Appeal. The decisions or determinations made by the city engineer as provided in this section shall be final unless the owner files an appeal to the zoning board of adjustment within five business days of the owner's receipt of the city engineer's determination.
