Babylon Town Code Chapter 213 (Signs) classifies garage sale, yard sale, and tag sale signs as temporary residential signs. Such signs are permitted without a Town sign permit but are limited to a maximum face area of 4 square feet, must be placed only on the private property of the sale host or, with written permission, on another private residential property, and must be removed within 24 hours after the sale concludes. Attachment of any sign to utility poles, street trees, traffic signs, or public rights-of-way is strictly prohibited under both Chapter 213 and NY Vehicle and Traffic Law Β§1211 (no distracting signs near traffic control devices). Suffolk County Public Works also removes signs illegally posted in county road ROWs. Signs must not obstruct pedestrian sidewalks, driver sight triangles at intersections, or utility access. Enforcement is handled by Town Code Enforcement and the Department of Environmental Control, which routinely removes illegal roadside signs on Sutton Blvd, Deer Park Ave, and Route 109.
Illegal signs in ROW are removed without notice. Fines up to $250 per sign per day under Chapter 203. Repeat offenders may face escalating penalties up to $500.
