Political and campaign signs on private property in Ontario are protected speech under the First Amendment and the California Constitution Article 1 Section 2. Ontario Municipal Code Chapter 9 (Sign Code) applies content-neutral standards that limit any temporary sign (political or otherwise) in residential zones to 6 square feet per face with a maximum height of 6 feet, and in commercial zones to 32 square feet. Political signs may be posted for a period leading up to and including election day, and must be removed by the property owner within 10 days after the election to avoid being treated as abandoned. Signs cannot be placed within the public right-of-way, on traffic control devices, utility poles, street trees, or on City-owned property under Vehicle Code 21466.5 and OMC Chapter 8. Signs placed in the right-of-way may be removed by City crews without notice. Signs must also comply with California Outdoor Advertising Act Business and Professions Code 5405.3 if placed within 660 feet of a highway. Violations are subject to administrative citation.
