9 adds Section 120 to the Building Code, defining a small residential rooftop solar energy system as one no larger than 10 kilowatts AC nameplate rating or 30 kilowatts thermal, installed on a single- or duplex-family dwelling or accessory structure, that meets applicable state fire, structural, and electrical codes and does not exceed the maximum legal building height. Applicants must first verify, through standard engineering evaluation, that the roof structure can carry the system's loads, and, at their own cost, confirm the existing electrical system can handle the added photovoltaic load.

Once an application meets the posted Expedited Application Requirements checklist, it is deemed complete, and permit issuance is non-discretionary: same day over the counter or within one to three business days electronically. Only one inspection is required, which may be a consolidated inspection by the building official and fire marshal; a failed inspection allows a follow-up inspection without the one-inspection limit applying. If the application is incomplete, the chief building official must issue a written correction notice within five business days. The building official may require a limited review permit, and can deny it only with written findings that the system would have a specific, adverse impact on public health or safety with no feasible mitigation. Connecting the system to the utility grid still requires separate authorization from the chief building official and the utility provider after inspection.
