National City, CA Solar Energy: Expedited Solar Permitting (2026)

Chapter 15.81 of the National City Municipal Code, Small Residential Rooftop Solar Systems, was adopted by Ord. No. 2015-2405 on 9-1-2015 to comply with the Solar Rights Act and AB 2188. Section 15.81.030 applies it to the permitting of all small residential rooftop solar energy systems in the city. A qualifying system is no larger than ten kilowatts alternating current nameplate rating or thirty kilowatts thermal, sits on a single or duplex family dwelling, and has an array that does not exceed the maximum legal building height defined by the city. Systems permitted before the ordinance are not covered unless changes materially alter their size, type, or components, and routine operation and maintenance or like-kind replacements need no permit.

Before filing, section 15.81.050 requires the applicant to verify through standard engineering evaluation that the support structure can carry the wind, seismic, dead, and live loads, and, at the applicant's cost, to verify through standard electrical inspection techniques that the existing wiring, main panel, and subpanel are adequately sized. The planning and building department adopts an eligibility checklist, and all required documents are posted on the city website. The application goes to the building division in person or by mail with the permit processing and inspection fees. The code states that electronic submittal is currently not available in National City. The process must substantially conform to the California Solar Permitting Guidebook adopted by the Governor's Office of Planning and Research.

Under section 15.81.060 the chief building official reviews only whether the application meets local, state, and federal health and safety requirements. Approval does not authorize connecting to the grid: the applicant must obtain permission from the local utility provider. The chief building official can send an applicant to a minor use permit only on a finding, based on substantial evidence, that the system could have a specific, adverse impact on public health and safety, and those decisions can be appealed to the city planning commission. Any condition imposed must mitigate that impact at the lowest possible cost. Only one inspection is required by the building division, and it can be consolidated with the fire marshal. A system that fails gets a subsequent inspection, which need not follow the one-inspection rule.
