Tustin, CA Solar Energy: Expedited Solar Permitting (2026)

Tustin City Code § 8205 sets the expedited permit review and inspection standard required by state law AB 2188. The Building Division must adopt an administrative, nondiscretionary review process using the checklist and standard plan from the California Solar Permitting Guidebook, and that review is limited strictly to whether the application meets local, state and federal health and safety requirements, not discretionary design or aesthetic criteria. Once a complete application meeting the approved checklist and standard plan is submitted, the Building Division must accommodate the building permit application within three business days.

The section caps inspections at one required visit for systems eligible for expedited review, though a failed inspection authorizes a follow-up. Denial is tightly constrained: it can occur only when supported by written findings identifying substantive evidence that the installation would have a specific, adverse impact on public health or safety with no feasible method to mitigate it, and any such denial must state why proposed alternatives were rejected; a denied applicant can appeal to the Building Board of Appeals under the 2013 California Building Code as amended by the Tustin City Code.

Approval conditions must be designed to mitigate the adverse impact at the lowest possible cost, and the city cannot condition approval on a homeowners association's sign-off. Systems already installed or permitted before the ordinance took effect are exempt unless later modifications materially change their size, type or components.
