California Civil Code §714 (Solar Rights Act) prohibits Carmichael HOAs from materially restricting rooftop solar installations or substantially increasing cost. HOAs may impose 'reasonable restrictions' (under 10% cost increase or 10% efficiency decrease).
California Civil Code §714 voids any HOA CC&R provision that effectively prohibits or significantly restricts a solar energy system. 'Reasonable restrictions' are limited to those that don't significantly increase cost (≤10%) or decrease efficiency (≤10%) of the system. Carmichael HOAs may require reasonable color matching of conduit and ground-mount placement modifications. AB 2188 (2014) adds that HOAs may require an application but cannot levy fees that meaningfully delay installation. SB 71 (2019) requires HOA approval/denial within 45-60 days. Solar Rights Act also protects solar water heaters under §714.1.
An HOA that violates §714 is liable for the homeowner's attorney fees and civil penalty up to $1,000 per occurrence. Civil action in Sacramento Superior Court is the typical remedy.
