HOAs retain authority to adopt reasonable rules on location, appearance, and method of installation, such as requiring the array to be behind the roof line visible from the street when practical, limiting ground-mount arrays to fenced backyards, or requiring matching frame colors. However, the HOA cannot ban installation if placing the device elsewhere would reduce estimated energy production by more than 10 percent, add substantial cost, or deny the owner the effective use of the device. The HOA architectural committee must provide written reasons for any denial. Texas Property Code Section 202.011 similarly restricts HOA regulation of flags, and Section 202.010 also addresses composite shingle roofing. Disputes are commonly addressed through the HOA appeal process first, followed by civil suit in Tarrant County district court under Section 209.008, which authorizes injunctive relief and attorney fees for prevailing owners. Owners planning installation should submit the architectural request early with proposed panel layout and specifications and document production estimates to support their application.
