Texas Property Code Section 202.010 substantially limits the authority of homeowner associations to restrict solar energy devices. An HOA may not prohibit a property owner from installing a solar device on a roof. Restrictions that lower production by more than 10 percent, raise installation costs by more than 10 percent, or substantially restrict the systems efficiency are void. HOAs may reasonably regulate aesthetics, such as requiring panels on a non-street-facing roof if that location does not materially reduce output, or requiring equipment to be matched in color to roofing. Ground-mount systems may receive more scrutiny than rooftop systems. The HOA architectural committee may still require standard review forms and submittals. If an HOA denies a reasonable solar request, Texas law provides statutory remedies including attorney fees for prevailing homeowners. Separately, Texas Property Code Section 202.011 governs roofing materials. Mansfield city zoning does not generally impose aesthetic limits on residential solar beyond fire and setback codes.
