§ 135-23.2. Do Not Knock Registry; Do Not Drop Registry; Unsolicited or Non-Subscribed Materials Prohibited. ... A. Do Not Knock Registry. ... There is hereby established a "Do Not Knock Registry" to be maintained in the Office of the Township Clerk. The purpose of the Do Not Knock Registry is to permit residents to bar any commercial solicitation, peddling or hawking taking place by foot, wagon, motor vehicle or any other conveyance on the door-to-door basis. Residents may register for such list by personal delivery, regular mail or e-mail to the Township Clerk. After registration on the Do Not Knock Registry, it shall be a violation of the terms of this Section of the Code of the Township of East Brunswick to visit any residences for commercial solicitation, peddling or hawking to any registered person and/or such person's property.
Full Breakdown
Section 135-23.2, added 5-6-13 by Ord. No. 13-14, declares it Township policy that residents should have the option to be relieved from unwanted commercial solicitations, hawking, inquiries and general disturbances from commercial solicitors, itinerant peddlers, hawkers and canvassers. The Township Clerk maintains the Do Not Knock Registry, and a resident registers by personal delivery, regular mail or e-mail. After registration, no commercial solicitation, peddling or hawking of any nature or kind is permitted on the property, whether the seller arrives by foot, wagon, motor vehicle or any other conveyance.
The Do Not Drop Registry works the same way for paper. After registration, no circulars, publications, handbills, brochures, shoppers or flyers, whether of a commercial, religious or charitable nature, can be distributed to the property. Subsection C lists exceptions: United States Postal Service mail, courier and overnight express deliveries, subscribed newspapers placed firmly in a receptacle or tightly wrapped, laundry, dry cleaning, dairy and bakery deliveries made by agreement or invitation, personal drop-off of non-commercial handbills of a political, charitable or religious nature packaged so they do not blow or scatter, and hawkers and peddlers licensed under Chapter 135 who abide by all provisions of both registries.
A sign works without any registration. Under § 135-23.1, no itinerant vendor, nonprofit organization, peddler, solicitor or canvasser can solicit a residence with a posted sign indicating they are not welcome, such as "No Solicitation," "Solicitors Are Not Welcome" or "Canvassers Are Not Welcome." Each one must look for signs first and, if one is posted, immediately and peacefully depart without question. Hours also apply under § 135-22: licensed peddlers and solicitors cannot do business before 9:00 a.m. or after 6:00 p.m. on weekdays, ice cream and custard peddlers can run from 9:00 a.m. to 9:00 p.m., and canvassers can work from 9 a.m. to 9 p.m.
Violations & Fines
Under § 135-23.1, anyone who violates Article III is sanctioned under § 135-26.4 and/or Section 1-15 of Article I of the Township Code. Section 135-26.4 sets a fine not to exceed $2,000 or imprisonment not to exceed 90 days, or both, and treats each day a violation occurs or continues as a separate offense. The Director of Public Safety can revoke a permit or license issued under Article III for good cause after notice and hearing.
