Full Breakdown
The Village of Hamburg Board of Trustees gives residents two tools against door-to-door visits, both in Chapter 175, the Soliciting and Peddling Law: a fixed hours limit and a no-solicitation registry.
The hours limit is in § 175-10.1, added 9-2-2003 as L.L. No. 2-2003. No person, peddler, solicitor or person engaged in merchandising, whether licensed or unlicensed, can enter on private property, go from house to house, go from place of business to place of business, or otherwise disturb persons in their residences or businesses on Saturday, Sunday or between 9:00 p.m. and 9:00 a.m. A license from the Village Clerk does not widen those hours.
The registry is in § 175-11. Any resident of the Village of Hamburg who does not want to be visited or called upon by solicitors, peddlers or anyone merchandising can register at the office of the Village Clerk on a list of registrants who do not desire to be visited or solicited at home. The resident can appear in person or register on forms supplied by the Village Clerk. The Clerk keeps a registration book showing the names and addresses of registered residents, and furnishes each one a sticker that can be affixed to the front door of the principal residence advising that no soliciting and peddling can be done.
The list is built into licensing. Every license applicant has to personally read the list of registered residents, sign an affidavit that the list has been reviewed, and obtain a photostatic copy of the list from the Village Clerk.
Section 175-11(C) extends the same protection to any resident or business that places a sign on its principal residence or business advising that no soliciting and peddling can be done, in accordance with § 250-62 of the Village Code. Subsection (D) makes it unlawful for any person, peddler, solicitor or person engaged in merchandising, licensed or unlicensed, to enter residential or business premises in the Village of Hamburg where the owner, occupant or person legally in charge has posted at the entry a sign or sticker bearing the words No Peddlers, Solicitors, or words of similar import. Section 175-5 still exempts a person soliciting at the express invitation of the person solicited.
Violations & Fines
Under § 175-15, a person who violates any provision of Chapter 175 is subject on conviction to a fine not to exceed $250 and/or imprisonment for a term not to exceed 15 days, or both, per each day on which the violation occurs. The Village Clerk can also summarily revoke a license under § 175-12 for a violation of any municipal law.
