In Las Cruces a posted "no peddlers" or "no solicitations" sign is legally binding: peddlers may not enter that property, and any solicitor asked to leave must go or face a petty misdemeanor. Peddling is also barred between 9 p.m. and 9 a.m. except by invitation.
Chapter 21 gives residents real protection at the door. It is unlawful for a peddler to enter any private premises posted with a sign stating "no peddlers allowed," "no solicitations allowed," or words to that effect. A peddler who enters and refuses to leave after the occupant tells them to is guilty of a petty misdemeanor. No peddling is allowed within the city between 9:00 p.m. and 9:00 a.m. except by specific appointment or invitation. The separate anti-solicitation article (Sections 21-61 to 21-64) reinforces this: it is unlawful to solicit money or goods on private property when the occupant has asked them to stop or posted a no-solicitation sign, and aggressive solicitation is banned in any public area.
Ignoring a posted no-solicitation sign, refusing to leave when asked, or peddling during prohibited hours is a petty misdemeanor. Penalties reach a $500 fine, 90 days in jail, or both, and aggressive or roadway solicitors may be removed immediately.
