Summary

In Monroe Township, Middlesex County, an owner or occupant can put an address on the Do Not Knock Registry kept by the Township Clerk, at no charge. Separately, § 77-10 sets solicitation hours and bars solicitation at any home with a posted No Solicitation sign.

A. A registry shall be established in the Township Clerk's office which contains a list of addresses of those premises where the owner or occupant has notified the Township Clerk that they wish to prohibit persons and entities from canvassing, soliciting, peddling, itinerant vending or attempting door-to-door sales on their premises. The form is available in the Office of the Township Clerk and on the Monroe Township website. There shall be no charge for registering. (2) A resident shall remain on the registry until a written request is made to the Township Clerk to have the residence removed from the registry. ... (4) Any vendor shall be obligated to obtain a current up-to-date copy of the registry. Full Breakdown

Section 77-10.1 of the Monroe Township Code, added 4-6-2020 by Ord. No. O-3-2020-005, sets up the registry in the Township Clerk's office. A household asks to be listed by submitting a Do Not Knock Registry request form to the Township Clerk. The form is available in the Office of the Township Clerk and on the Monroe Township website, and there is no charge for registering. A listing stays in place until the resident makes a written request to the Township Clerk to be removed. The list of addresses is available at the Clerk's office during normal business hours.

The burden of checking the list falls on the seller. Any vendor must obtain a current up-to-date copy of the registry, and the Township Clerk must provide a copy to any person seeking to canvass, solicit, peddle, act as an itinerant vendor or undertake any door-to-door sale. Section 77-10.1(B) lists five exceptions: mail and parcels handled under United States Postal Service rules; packages delivered by a commercially recognized courier such as Federal Express or United Parcel Service; subscribed newspapers and periodicals placed in a receptacle or tightly wrapped; laundry, dry cleaning, dairy, bakery and similar food deliveries and commercial product sampling by agreement with or invitation of the owner or occupant; and personal drop off of noncommercial handbills of a political, charitable or religious nature, packaged so they do not blow and scatter.

The registry sits beside the permit rules of Chapter 77. Under § 77-10(A), commercial peddling, distribution and solicitation is allowed only between 8:00 a.m. and 6:00 p.m., and solicitation for charitable, political, religious, nonprofit or other non-commercial purposes is allowed only between 8:00 a.m. and 9:00 p.m., unless the occupant invited the person into the house or an appointment was made earlier. Section 77-10(J) bars any solicitation, commercial or noncommercial, at a private residence where a "No Solicitation" sign is posted on the property, and § 77-10(D) bars entering or attempting to enter a resident's home without an express invitation from the occupant.

Violations & Fines

Section 77-12 covers any violation of Chapter 77: a fine or penalty of not more than $500 or imprisonment for a term not to exceed 90 days, or both, in the discretion of the court. Each time a violation is committed or permitted to continue is a separate offense with a like fine. Under § 77-8 the Township Clerk and/or Police Department can revoke a permit after notice and hearing, and § 77-9 gives the aggrieved person 14 days to appeal to the Township Council.
