Commercial solicitors must apply for a Solicitor's Permit from the City of Atlanta. The application requires identification, a description of the goods or services being solicited, a background check, and a permit fee. Permitted solicitors must carry their permit and display it upon request. Soliciting is restricted to daylight hours (8:00 AM to 9:00 PM). Solicitors must immediately leave any property where the occupant requests them to do so. The city maintains a registry of permitted solicitors. Charitable organizations soliciting donations must register separately under the state charitable solicitation law. First Amendment-protected activities (religious proselytizing, political canvassing, petition gathering) do not require a commercial solicitor's permit.
Soliciting without a permit is a misdemeanor under the city code and can result in fines up to $1,000 and up to 6 months in jail. Refusing to leave a property after being asked is a separate trespassing offense. Fraudulent solicitation carries additional state criminal penalties.
