Nonprofit solicitors must obtain a separate permit from the Finance Department at City Hall. Permits require identification, background check, and a fee. Soliciting is prohibited before 9:00 AM and after 9:00 PM.
Costa Mesa Municipal Code Title 9, Sections 9-114 through 9-133, regulates all door-to-door peddling and soliciting within city limits. Any person, firm, or corporation going house-to-house or place-to-place selling, taking orders for goods or services, or offering to sell goods or services for future delivery must obtain a peddler or solicitor permit from the Costa Mesa Police Department. This includes individuals selling products, taking magazine subscriptions, offering home services, and similar commercial solicitation activities. The permit application requires valid photo identification, a completed application form, and payment of the permit fee. The Police Department conducts a background check on each applicant. Permits are non-transferable and must be carried at all times while soliciting. Solicitors must present the permit upon request by any resident or law enforcement officer. Nonprofit organizations seeking to solicit donations must obtain a separate permit from the Finance Department at City Hall, not the Police Department. Soliciting is prohibited before 9:00 AM and after 9:00 PM. Solicitors must immediately leave any property upon request of the resident or occupant. Solicitors may not enter properties displaying 'No Soliciting' signs. The permit does not authorize soliciting in areas where the HOA or property management has posted no-soliciting notices. For permit information, contact the Costa Mesa Police Department at (714) 754-5280.
Soliciting without a valid permit is a misdemeanor under the Costa Mesa Municipal Code. First offenses typically result in a warning and order to cease activity. Continued violations may result in arrest and criminal charges with fines up to $1,000 and/or up to six months in county jail. Soliciting after being told to leave a property may constitute trespassing under California Penal Code Section 602.
