Margate, FL Special Events & Permits: Block Party Permits (2026)

Section 40.630 of the Margate Land Development Code requires a Temporary Use Permit (TUP) for outdoor temporary uses, and block parties are sorted by expected attendance. A block party in a residential area with 75 people or fewer needs no TUP but must notify the Police Department seven calendar days in advance. Between 75 and 500 people, the Development Services Department issues the TUP administratively, with review from other City departments. At 500 or more, the application goes to the City Commission, which approves by resolution and can attach reasonable conditions.

Timing is fixed. An administrative TUP application is filed with Development Services at least 30 calendar days before the event with the fee; a Commission-level application is due at least 90 calendar days ahead. The fee is set by the City Commission, and tax-exempt organizations qualifying under Section 501 of the Internal Revenue Code pay nothing unless they hold 501(c)(4) status. Notice and public hearing requirements do not apply to administrative TUPs.

The application needs a notarized affidavit from the landowner granting permission, a detailed description with dates, hours, water and electric service, restroom access and security, and a site plan showing the event layout, tents, cooking areas, seating, parking, restrooms and garbage collection. The applicant also signs a hold harmless agreement and provides proof of insurance naming the City of Margate as additional insured.

Duration limits apply to every TUP. An event can run no more than 21 consecutive calendar days in total, split into up to three days of set-up, up to 15 days for the event and up to three days of tear-down. Events close by 10:00 p.m. unless the City Commission approves a later time. Each property is limited to four TUPs in a calendar year, no two events can run back to back, and the same property cannot receive a TUP more than once in any thirty-day period. The use must be compatible with surrounding land uses and cannot create a parking problem.
