§ 163-6K(2) of Chapter 163, the Parks and Recreation Law of the Town of Clay adopted May 1, 1978, states plainly that 'no parade, drill, or maneuver of any kind shall be conducted, nor shall any procession form for parade or proceed in any park without a permit.' The permit power sits with the Commissioner of Recreation and Human Resources under § 163-5, which requires strict compliance with the permit's terms and conditions; violating them is grounds for the Commissioner to revoke the permit, and any money already paid may be forfeited to the town at the Commissioner's option.

The permit requirement applies specifically to activity within town parks and recreational areas under the territorial scope set at § 163-4B, which covers 'all town parks and recreational areas.' The neighboring clause, § 163-6K(1), separately requires a permit for meetings, ceremonies, speeches, exhibitions, performances, public fairs and organized racing in a park, so a parade organizer planning speeches or a fair alongside the procession needs to clear both subsections. Enforcement runs through the prevailing law enforcement agency, park rangers, or another authorized peace officer under § 163-15, and any of them may issue an appearance ticket under § 163-13 directing the violator to appear in local criminal court.
