Summary

In the City of Huntington Park, California, an organized gathering of 100 or more people at a public place, or a concert, festival or similar event in a City park, needs a written activity permit from the City. Public parks are open only from 6:00 a.m. to 10:00 p.m., and fees are set by City Council resolution.

A. Except as provided otherwise by this Code or pursuant to the terms of a permit, lease or contract which has been specifically authorized by the City Council, no person shall conduct or cause to be conducted, participate or engage in, hold, manage, permit or allow another to conduct an activity/event, in, on or upon any City street, sidewalk, alley, park, way, public place, public property or public right-of-way which is owned or controlled by the City without first having obtained a written permit from the City as provided for in this article. ... D. Issuance of a permit pursuant to this chapter does not obligate or require the City to provide City services, equipment or personnel in support of an event although the City may provide such services, equipment or personnel if such are reasonably available and the event organizer makes provisions to reimburse the City for the actual cost there-of.

Full Breakdown

Section 9-2.1502(A) of the Huntington Park Municipal Code bars anyone from conducting or taking part in an activity or event in any City street, sidewalk, alley, park, public place or public property without first obtaining a written permit. Section 9-2.1501 defines an activity to include any organized assemblage of 100 or more persons at a public place, property or facility, and lists concerts, parades, fairs, festivals, block parties, athletic or sporting events and community celebrations as examples.

Applications are filed with the Community Development Department (§ 9-2.1504(A)). Smaller events need an application not less than 30 calendar days ahead and can be approved administratively. An event with 100 or more participants, a street closure, or use of four or more public parking spaces for one or more days needs Council approval and filing not less than 90 calendar days ahead. An application involving expressive activity in a park is due at least 3 business days before the event.

The City can attach conditions under § 9-2.1502(C), including a cleaning deposit for events with structures, large animals, water stations, or food and beverage sales, first aid and sanitary facilities, a waste management plan, limits on sound amplification, and rules for alcohol sales and service. A permit does not oblige the City to supply services or personnel (§ 9-2.1502(D)). Every vendor needs a City of Huntington Park business license, and anyone preparing or selling food must furnish a Los Angeles County health permit (§ 9-2.1510). A permit runs no more than three consecutive days (§ 9-2.1506).

Park hours come from § 5-21.104: parks are open between 6:00 a.m. and 10:00 p.m. After-hours presence requires a special permit from the Director of Parks and Recreation or participation in a City sponsored or City-approved event. The Director or the Parks and Recreation Commission can close any park or part of one, and soccer is limited to the fenced areas of Salt Lake Park and West Side Park under § 5-21.102(q).

Violations & Fines

Under § 9-2.1512, intentionally violating the activity permit article is a misdemeanor. In the park chapter, § 5-21.103 makes a violation of the alcoholic beverage subsection a misdemeanor and any other violation an infraction fined under § 1-2.01: $50 on a first conviction, $100 on a second within one year, and $250 on a third or later within one year. Being in a park outside posted hours without an exception is unlawful.
