The hour restriction carries built-in geographic exceptions: it does not apply to Fort Fisher, the Brazos Commons, Martin Luther King, Jr. Park, Indian Spring Park West, or to vehicular traffic simply driving through Cameron Park. For every other city park, an event that needs to run past midnight, whether a late festival, a vigil, a concert, or a private gathering, needs its own carve-out from the parks and recreation commission. The section spells out the process: a written application must be made to the commission to obtain after-hours approval at least 30 days before the event for which approval is sought.

That 30-day filing runs separately from, and in addition to, any special event or parade permit the gathering may also need from the outdoor events manager under Chapter 13, Article XIV if it meets that article's attendance or public-property thresholds. Because the parks and recreation commission is a distinct approving body from the outdoor events manager, an event organizer planning a late-night park gathering has to track two clocks and two applications rather than one. Section 17-8(b) also builds in a due-process step for enforcement: no arrest may be made and no citation issued for a park-hours violation unless the officer or park ranger first informs the person that they are in the park during prohibited hours and gives them a chance to leave.
